<jats:p>The article examines the problem of distinguishing between unfair competition and trademark infringement under the legislation of the Republic of Uzbekistan. It is substantiated that infringement of an exclusive right and unfair competition are independent legal categories with different legal nature, object of protection, range of subjects and mechanism of legal response; however, in certain cases they may overlap, in particular when means of individualization are used and confusion is created in the market.</jats:p>
