<jats:p>Abstract In the context of the ongoing discussion of a draft amendment to Article 21.12 of the Criminal Code, premised on the critical need to enact effective and robust legislation, this paper articulates a view aimed at addressing critical issues in the investigation and adjudication of crimes involving torture. By elucidating these issues through factual evidence and illustrative examples, it seeks to delineate the characteristics of such offenses to restrict opportunities for human rights violations. Additionally, it advocates for aligning the definitions within the Criminal Code with the provisions of international treaties and conventions. The study further explores mechanisms to ensure that penalties for organized acts of torture are proportionate to the severity of the offense and its resultant harm.</jats:p>
