<jats:p>Abstract Although the State enacts laws to safeguard human rights, statistical data indicate that violations of these rights not only persist but continue to rise. Each year, concrete facts concerning human rights violations are made public, and the competent authorities issue recommendations and guidelines to remedy such breaches. Nevertheless, these measures fail to produce the necessary outcomes. An analysis of complaints and reports regarding human rights violations reveals that the overwhelming majority occur within the domain of criminal procedure—a phenomenon that has attracted the interest of scholars in the field. In this context, an examination of the current implementation of legislation and the results of surveys conducted among stakeholders demonstrates that investigators, prosecutors, and judges exhibit an insufficient inclination and understanding toward implementing a human rights–based approach to criminal proceedings. Furthermore, these shortcomings are inextricably linked to the underlying concepts, philosophy, and working methods embedded in laws that have been in force for many years.</jats:p>
