Biodiversity Litigation

<jats:p>Biological diversity enjoys judicial protection, but due to the fragmented character of the legal regime, the localization of biodiversity loss, as well as the localized nature of measures to prevent it, judicial practice in this area is fragmented and unsystematic. The growing number of cases on conservation of species and ecosystems does not produce qualitatively different results beyond the resolution of a specific legal issue — litigation is not strategic, that is, aimed at generating broad social and legal effects. This paper examines the main trends in biodiversity litigation at the national and international levels, seeking to categorize them and identify their common features.</jats:p>
