Վիճարկման հայցատեսակով պետական շահերի պաշտպանության հայց հարուցելու դատավարական ժամկետների հաշվարկման հիմնախնդիրները ՀՀ վճռաբեկ դատարանի դիրքորոշման համատեքստում / Problems of Calculating Procedural Deadlines to Initiate a Claim for the Protection of Interests via Dispute Claims within the Scope of RA Court of Cassation Positioning

<jats:p>The article examines the powers of the Prosecutor's Office of the Republic of Armenia to initiate claims for the protection of the state's property and non-property interests in administrative proceedings, analyzing the relevant provisions of the Constitution of the Republic of Armenia, the Law of the Republic of Armenia "On the Prosecutor's Office," and the Code of Administrative Procedure of the Republic of Armenia. In light of the jurisprudence of the Constitutional Court and the Court of Cassation of the Republic of Armenia, the study focuses on the calculation of procedural time limits according to the type of disputed claim, highlighting the legislative gap arising from the absence of procedural deadlines for the subjects authorized under Part 3 of Article 3 of the Administrative Procedure Code to initiate claims. The authors examine whether this gap can be effectively addressed through law enforcement practice and the development of consistent judicial practice, ultimately presenting specific conclusions and legislative proposals.
