Քրեական ենթամշակույթի ծագման պատճառները և դրա դեմ պայքարի ժամանակակից միջոցները / The Reasons for the Formation of Criminal Subculture and Modern Means of Combating It

<jats:p>Currently, there is a high degree of criminal subculture in the Republic of Armenia, unlike the previous norms of the Criminal Code adopted on 01.08.2003, where there are no articles on criminalization of acts related to criminal subculture, the Criminal Code. The Code, adopted and in force since 01.07.2022, has envisaged 4 articles providing for criminal offences related to subculture (arts. 322-324). In this novel approach of the law, it is obvious that criminal subculture and its uncontrolled spread are phenomena of high public danger, and a legislative and regulatory fight against them is planned. It should be noted, however, that the establishment of criminal prohibitions alone is not sufficient for the criminal law to fulfil its preventive function. Criminal subculture has a high degree of latency, as people avoid reporting its existence to law enforcement agencies; there are many reasons for this silence, but the most persistent reason is personal safety, with which the person alerting law enforcement agencies may have problems. The most dangerous phenomenon is the uncontrolled spread and growth of criminal subculture and its propaganda. The aim of the work is to systematically analyze the social phenomenon of criminal subculture, to highlight the existing problems in the discussed sphere, as well as to present criminal groups belonging to criminal subculture defined by the current Criminal Code of the Republic of Armenia. To study and highlight the means of combating criminal subculture individually and by complex means and to make new effective recommendations.
