Մարդու օրգանների ապօրինի շրջանառության համար քրեական պատասխանատվությունը / Criminal Liability for Illegal Trafficking of Human Organs

<jats:p>Illegal organ trafficking constitutes a crime against human life and health that poses a serious threat to legally protected social relations. This article examines the institute of criminal liability for illegal trafficking in human organs from both domestic and international legal perspectives, emphasizing its global significance. Through a comparative analysis of previous and current legal regulations and by distinguishing this offense from human trafficking, the study explores its criminal-law characteristics, including legislative prohibitions on advertising the commercial nature of human organs, existing legal gaps and contradictions, the risks associated with illegally trafficked artificially grown organs, and the need for a comprehensive legislative definition of qualifying circumstances. Based on the research findings, the author proposes establishing criminal liability for the illegal trafficking of artificially grown biological organs, the commercial advertising of human organs, and mediation in illegal organ trafficking, while also recognizing as aggravating circumstances the commission of the offense by a criminal organization or against a pregnant woman, a helpless or vulnerable person, or a person dependent on the offender.
