<jats:p>This article critically examines Héctor Hugo Barbagelata’s doctoral thesis,defended in 1947 at the University of Paris and recently rediscovered. It argues that the work anticipates, from a Latin American perspective, a normative theory of  social constitutionalism in labour law, offering analytical categories that remain central to contemporary debates on the effectiveness of social rights</jats:p>
