Abstract
<jats:p>This article examines the distribution of powers between state bodies and local governments in the context of constitutional and legal norms and the European Charter of Local Self-Government. This study examines theoretical approaches presented in the professional literature on the distribution of powers between state bodies and local governments, as well as the norms established by the European Charter of Local Self-Government and the constitutional and legal norms of individual states. The purpose of this article is to study the system of distribution of public affairs in the relationship between state bodies and local governments and to identify problems in the distribution of powers between these bodies. This article examines issues that have been addressed to varying degrees in the works of various authors, and also addresses issues that have not been the subject of separate, comprehensive academic discussion or legal research. Based on the legal analysis conducted, in order to clarify the nature of the distribution of powers between state bodies and local governments, as well as the limits of their exercise, the author identifies two different manifestations of the exclusivity of powers: "institutional exclusivity" and "functional exclusivity".</jats:p>
