<jats:p>The article provides a comprehensive examination of a number of key issues relating to nonpecuniary damage in cases where a fundamental right is violated as a result of unlawful administrative conduct. In formulating the proposed conclusions, both domestic and international judicial practice have been analysed, alongside a review of several arguments advanced in theoretical legal scholarship. The purpose of the study is to identify the prerequisites for obtaining compensation for nonpecuniary damage in cases of violation of a fundamental right caused by unlawful administrative conduct, to clarify the core issues related to proving the existence of non-pecuniary damage, as well as to examine the possibility of compensating non-pecuniary damage through an apology and the ability of legal persons to obtain such compensation.</jats:p>
