Abstract

<jats:p>This article examines the legal status of notaries and notarial activity within the system of protecting constitutional human rights. This study analyzes scholarly approaches presented in theoretical literature on notaries and notarial activity, as well as individual constitutional and legal norms. Based on the legal research conducted, it presents certain positions regarding notarial activity as: (a) a state function aimed at protecting the rights and legitimate interests of individuals and legal entities; (b) a legal institution designed to ensure the stability of civil transactions, including through notarial acts, and to protect the rights and legitimate interests of these same individuals; (c) an educational program whose subject and objectives are aimed at clarifying issues of notarial proceedings and activity; and (d) an element of the justice system, granting notaries the authority to perform notarial acts on behalf of the state in accordance with the procedure established by law. At the same time, as a result of research into the issues of notarial protection of human and civil rights and legitimate interests, this activity has come to be perceived not only as a type of professional public activity carried out on behalf of the state, but also as a guarantor of the balance of private and public interests in the system of protecting the constitutional rights of individuals and citizens.</jats:p>
