Abstract
<jats:p>This article is devoted to the study of conceptual issues related to one of the key topics in constitutional law - the theory of the direct effect of the norms of international treaties - as well as a systematic analysis of the views concerning the origin of this theory and certain features of its historical development. Given that in professional literature the emergence of the theory of the direct effect of international treaty norms is often associated with the provisions of Article VI, Section 2 of the US Constitution and their judicial practice, the work systematically analyzes the case law of the US Supreme Court, including the practical significance of individual court decisions. At the same time, special attention is paid to the study of the impact of the direct effect of international treaty norms on the domestic legal systems of various countries, including issues related to the recognition of their supremacy and the applicability of mechanisms ensuring their full implementation. As a result of the analyses conducted, the following conclusions were drawn: the emergence of the theory of the direct effect of international treaty norms is conditioned not only by the need for the effective fulfillment of obligations but also by the need for domestic legal regulation, as well as by the necessity of legal mechanisms within the international legal system that guarantee the full application of international treaties in the domestic legal system of the state.</jats:p>
