Abstract
<jats:p>The Constitution of the Republic of Armenia, in Chapter 2, Article 57, entitled “Fundamental Rights and Freedoms of Man and Citizen”, as an indicator of a social state, enshrines the right of everyone to freely choose their job. Article 82 of the Constitution of the Republic of Armenia stipulates that every employee, in accordance with the law, has the right to healthy, safe and decent working conditions, limitation of maximum working hours, daily and weekly rest, as well as annual paid leave. Among the guarantees for ensuring the labor rights and legitimate interests of citizens, the control and supervision over the observance of the legislation regulating the organization and application of their work is important. Within the framework of the protection of labor rights, the executive branch has its own unique role, represented especially by the RA Health and Labor Inspection Body. Within the framework of this work, the competence of the RA Health and Labor Inspection Body within the framework of resolving labor disputes between employees and employers has been discussed. Special attention has been paid to three legal issues: - does the RA Health and Labor Inspection Body have jurisdiction within the framework of resolving labor disputes?, - does the above-mentioned mechanism for protecting rights not lead to circumvention of the statute of limitations?, - does the RA Health and Labor Inspection Body have jurisdiction within the framework of clarifying the legality of dismissal orders to ensure the full and proper restoration of the violated rights of the employee? Accordingly, we considered it necessary to address the question of whether the RA Health and Labor Inspection Body has any jurisdiction in the process of resolving individual labor disputes.</jats:p>
