ԱՆԱԼՈԳԻԱՅԻ ԿԻՐԱՌՈՒՄԸ ՀՀ ՔԱՂԱՔԱՑԻԱԿԱՆ ԴԱՏԱՎԱՐՈՒԹՅՈՒՆՈՒՄ

<jats:p>This article examines the features of the application of analogy in the legal system of the Republic of Armenia, with particular emphasis on the necessity of applying analogy of law in the field of civil procedure. The main objective of the study is to identify the legal foundations, conditions, and limits of the application of analogy, taking into account its role in filling procedural gaps and ensuring the effectiveness of justice. For this purpose, a comprehensive analysis and comparative study of legislative regulations formed after the independence of the Republic of Armenia has been conducted. The main stages of the development of civil procedural legal relations, legislative changes, and their impact on judicial practice have been examined. Special attention is given to legal norms regulating mechanisms for overcoming procedural gaps, including the possibility of applying analogy of law. The article emphasizes that the incompleteness of procedural regulation in certain cases requires the use of analogy as an instrument for the development of law and the continuity of justice. At the same time, it analyzes the limits within which an analogy may be applied without violating the principles of legal certainty and predictability of law. Thus, the article aims to form a systematic understanding of the role of analogy in civil procedure and the necessity of its application within the context of the legal development of the Republic of Armenia.</jats:p>
