ԻՐԱՎԱԲԱՆԱԿԱՆ ԱՆՁԱՆՑ ՔՐԵԱԿԱՆ ՊԱՏԱՍԽԱՆԱՏՎՈՒԹՅՈՒՆԸ ՔՐԵԱԿԱՆ ՊԱՏԱՍԽԱՆԱՏՎՈՒԹՅԱՆ ՀԱՄԱԿԱՐԳՈՒՄ

<jats:p>This article is devoted to identifying the place of criminal liability of legal entities within the system of criminal liability of the Republic of Armenia. It substantiates that, under the current legislation, the criminal liability of a legal entity cannot be understood as the liability of a subject that has independently committed a crime in the classical sense, but should instead be interpreted as an autonomous construct operating within the system of criminal liability and based on special attribution. At the same time, the article reveals that there are insufficient systemic links between the general principles of criminal legislation and the special norms concerning legal entities. To overcome this gap, it proposes legislative amendments to Articles 5 and 6 of the Criminal Code aimed at clarifying the criteria for understanding and applying the principles of personal responsibility and fault-based liability with regard to legal entities.</jats:p>
