Abstract

This article examines the forms and mechanisms of implementing transitional justice, including criminal justice, fact-finding, restorative accountability procedures, truth compensation, reforms, lustration, and other measures. These mechanisms are applied to violations that cannot be fully assessed legally through ordinary courts and are aimed at ensuring both legal evaluation and the establishment of social truth, particularly in the context of radical and systemic violations. The article examines the necessity of implementing radical and systemic reforms through the application of lustration and vetting as a means of neutralizing the influence of the former regime and restoring public trust in new state and judicial institutions. It presents international experience in conducting vetting, particularly through the examples of Albania and Bosnia and Herzegovina, emphasizing the conditions for its effectiveness and potential risks.
