Abstract

<jats:p>The determination of custody in family law proceedings is a complex issue that requires the integration of legal and psychological criteria aimed at ensuring the overall well-being of children and adolescents. The objective of this study was to analyze the main legal criteria applied in custody determinations, as well as the relevance of forensic psychological reports in judicial decision-making. To this end, an integrative systematic review with a qualitative approach was conducted, following the PRISMA guidelines. The search was performed in academic databases such as Scopus, Web of Science, SciELO, Redalyc, and Dialnet, including studies published between 2000 and 2024 related to forensic psychology, family law, and psychological assessment. The results showed that the best interests of the child constitute the central principle guiding judicial decisions in custody proceedings. Furthermore, it was found that forensic psychological reports play a significant evidentiary role by providing technical information on parenting skills, emotional bonding, emotional stability, and risk factors present in the family environment.</jats:p>
