Abstract

This thesis provides a systematic analysis of family court proceedings in child custody cases following separation and divorce, from the perspective of the child. It reviews the legal and practical conditions for children’s participation, identifies shortcomings, and suggests reforms. Drawing on interdisciplinary and transdisciplinary perspectives, the author emphasises the resources necessary for meaningful participation. Particular focus is placed on the participation of disabled children. Finally, it critically assesses the compulsory training requirement for family court judges, which has been in force since 1 January 2022. This Title is also Available as Open Access.
