Abstract

<p>Machine-generated data—such as sensor and log data from networked devices, platform logs, or outputs from data processing systems—is becoming increasingly important as evidence in civil proceedings. This dissertation analyzes how such data can be classified within the body of evidence under the German Code of Civil Procedure, who has control over it in court proceedings, and what criteria courts use to determine its probative value. Based on this, the thesis develops approaches for overcoming typical evidentiary difficulties and standards for proper evaluation of evidence. The author is corporate attorney and advises on legal issues relating to the use of AI systems.</p>
