Abstract
<p>This study examines the protection of same-sex sexuality in European human rights law as a fundamental question of the relationship between equality and autonomy. Starting with a legal-philosophical analysis of sexuality and sex, the study reconstructs the European Court of Human Rights' case law on homosexuality, revealing the tension between liberty- and equality-based approaches. Building on this, it proposes a systematic approach to the protection of same-sex sexuality based on the concept of sex equality as a prohibition of hierarchy.</p>
