Abstract
<jats:p>Статья посвящена актуальной для отечественного правопорядка проблеме организации управ- ления поэтажной собственностью и выявлению главенствующей роли диспозитивности в части самоуправле- ния внутри сообщества жильцов. В предложенном материале исследуются самостоятельные модели поэтажной собственности в различных юрисдикциях, устанавливаются сходства со структурой корпоративного управления в юридических лицах. Автор критически оценивает перспективу применения иностранного опыта в российской действительности. Автором выявляется роль диспозитивности и самоуправления в поэтажной собственности. Автор обобщает лучшие современные практики, которые можно предложить отечественному правопорядку для более качественного регулирования чувствительной области жилищных общественных отношений.</jats:p> <jats:p>The article is devoted to the problem of organizing the management of apartment ownership, which is relevant to the domestic legal system, and identifying the dominant role of dispositiveness in terms of self-government within the community of residents. The article examines independent models of apartment ownership in various jurisdictions and establishes similarities with the structure of corporate governance in legal entities. The author critically assesses the prospects for applying foreign experience in the Russian context. The author identifies the role of dispositiveness and self-government in apartment ownership. The author summarizes the best contemporary practices that can be proposed to the domestic legal system for better regulation of the sensitive area of housing public relations.</jats:p>
