CERTAIN ISSUES OF RENUNCIATION OF OWNERSHIP RIGHTS TO MOVABLE PROPERTY

<jats:p>This article analyses the theoretical and practical issues concerning the renunciation of ownership of movable property. It examines the legal nature of the renunciation of ownership as a unilateral transaction, its implementation through conclusive conduct, and the criteria for determining the owner’s intention. Drawing on the legislation and judicial practice of the Republic of Uzbekistan, as well as sources of Roman law and Islamic law, the article explores the legal status and subsequent disposition of abandoned movable property. A comparative analysis of the legislation of the Russian Federation is also conducted, and proposals are developed for improving the mechanisms governing the acquisition and termination of ownership of abandoned movable property under national legislation. The study concludes that it is appropriate to differentiate the procedure for appropriating movable property according to its value and to recognize the taking into possession of abandoned property as a unilateral transaction giving rise to ownership rights.</jats:p>
