"CRIMINAL USE OF CRYPTOCURRENCY: CRIMINAL-LEGAL ASPECTS"

<jats:p>This article examines the issues of criminal-legal qualification of crimes committed using cryptocurrency from the perspective of modern civil and criminal law. The author analyzes two main aspects in the scientific debate on the legal nature of cryptocurrency: the subject of the crime and as an instrument or means of committing the crime. The study shows that until the status of cryptocurrencies is fully and clearly defined in legislation, certain problems will remain in their classification in the field of criminal law. Currently, due to the ambiguity of their civil law nature, there are certain restrictions on recognizing them as the subject of a crime. Therefore, it is advisable to form a unified judicial and investigative practice for the qualification of acts involving the use of cryptocurrency in committing crimes and to develop appropriate approaches.</jats:p>
