Abstract
This article provides a comprehensive analysis of the theoretical and legal foundations of the mechanism of prosecutorial supervision over the implementation of legislation governing appeals by individuals and legal entities. It examines the concept of a “mechanism” in legal theory and substantiates its relationship with the institution of prosecutorial supervision. The mechanism of prosecutorial supervision is considered an interconnected system of legal means, methods, and measures of prosecutorial response. On this basis, the article identifies the role of prosecutorial supervision in the processes of receiving, registering, and reviewing appeals, making lawful decisions, and restoring violated rights. Particular attention is paid to the functional significance of prosecutorial inspections, protests, submissions, warnings, and other instruments of prosecutorial supervision within this mechanism. The article also provides a comparative legal analysis of the experience of Germany and France in organizing oversight of the consideration of appeals. Based on the findings, the author formulates an approach to defining the mechanism of prosecutorial supervision in this sphere and identifies priority directions for its further improvement.
