Abstract
This book is dedicated to the formation of «mediative thinking» within society. Business mediation teaches how to see real needs behind legal positions, facts behind emotions, and opportunities for innovation behind conflict. We invite you to study the art of negotiation, where the result is not a victory over an opponent, but a shared victory over the problem. After all, in the era of the knowledge economy, agreement is the most expensive resource, and mediation is the most reliable way to extract it. This study guide highlights the practices of alternative dispute resolution in business with the aim of developing negotiation skills and the ability to avoid conflict—or, should it arise, to prevent that conflict from escalating into a problem. The guide is intended for business managers, students, educators, researchers, practicing lawyers, and everyone interested in the issues of mediation. The study guide was prepared and published within the framework of the fundamental research project “Legal Support for Professional Adaptation and the Right to Entrepreneurship of War Veterans” (UkrISTEI Registration No. 0123U104874).
