Legal Prerequisites and Consequences of Failure to Publish a Decision to Designate an Extremist Organisation without State Registration. Using the Example of the International Public Movement AUE, Recognised as Extremist and Banned in Russia

<jats:p>This article examines the problems that arise when a public organisation is recognised as extremist even though it lacks state registration, a fixed membership, legal governing bodies, or published policy documents. It concludes that if court hearings regarding the banning of such an organisation are held behind closed doors and the decisions are not published (a practice that is becoming increasingly common), the problems are significantly exacerbated and become critical. In fact, court decisions on administrative claims expand administrative and criminal law prohibitions, the boundaries of which, due to the closed nature of the decisions, are unclear to both citizens and law enforcement officials. This creates the basis for arbitrary law enforcement and the violation of a number of constitutional principles: the rule of law, separation of powers, legal certainty, fairness, equality before the law and the courts, the prohibition against application of laws containing secret provisions, etc. The author proposes a number of measures to rectify this situation.</jats:p>
