Abstract
<jats:p>Предметом исследования являются примечания к статьям 201.2, 285.5 Уголовного кодекса РФ, предусматривающие специальные основания освобождения от уголовной ответственности за нарушение условий контракта по ГОЗ. Автор анализирует вопросы, касающиеся правильного правоприменения указанных примечаний, с учетом установления реальной воли законодателя в процессе интерпретационной деятельности, а также недопустимости ее искажения. В частности, изучаются подходы Пленума Верховного Суда РФ к толкованию иных аналогичных примечаний, предусматривающих специальные основания освобождения от уголовной ответственности. Предлагаются возможные изменения в действующую редакцию статей 201.2 и 285. 5 УК РФ, которые, по мнению автора, будут способствовать улучшению эффективности действия содержащихся в них примечаний. Выносится на обсуждение вопрос о необходимости закрепления разъяснений, касающихся примечаний к статьям 201.2, 285.5 УК РФ на уровне Пленума Верховного Суда РФ.</jats:p> <jats:p>The subject of this study is the notes to Articles 201.2, 285.5 of the Criminal Code of the Russian Federation, which provide for special grounds for exemption from criminal liability for violating the terms of a state defense contract. The article explores issues related to the correct application of these notes, taking into account the establishment of the legislator's real will in the process of interpretation, as well as the inadmissibility of its distortion. In particular, it analyzes the approaches of the Plenum of the Supreme Court of the Russian Federation to the interpretation of other similar notes that provide for special grounds for exemption from criminal liability. Possible changes to the current version of Articles 201.2, 285.5 of the Criminal Code of the Russian Federation are proposed, which, according to the author, will help improve the effectiveness of the notes contained in these articles. The issue of the need to clarify the notes to Articles 201.2, 285.5 of the Criminal Code of the Russian Federation at the level of the Plenum of the Supreme Court of the Russian Federation is being discussed.</jats:p>
