Abstract

<sec> <title>UNSTRUCTURED</title> <p>Background: The global regulatory environment for breast implants has changed substantially following major safety and regulatory events, including the Poly Implant Prothèse (PIP) scandal and concerns regarding breast implant-associated anaplastic large cell lymphoma (BIA-ALCL). In addition to clinical safety, regulatory authorities increasingly evaluate manufacturing quality, corporate compliance, and post-market surveillance when assessing high-risk implantable medical devices. Consequently, regulatory reapproval does not necessarily ensure successful international market re-entry. Objective: To evaluate the feasibility of international market re-entry for BellaGel following potential domestic reapproval by comparing the regulatory frameworks and market-specific challenges in the United States, the European Union, and China. Methods: A comparative regulatory and policy analysis was conducted based on publicly available regulatory frameworks, published scientific literature, and official guidance from major regulatory authorities. Regulatory pathways, pre-market requirements, manufacturing quality standards, post-market surveillance obligations, and historical compliance considerations were compared across the United States Food and Drug Administration (US FDA), the European Union Medical Device Regulation (EU MDR), and the China National Medical Products Administration (NMPA). Potential commercial barriers, physician acceptance, and strategic implications for market re-entry were also evaluated. Results: Substantial differences were identified among the three regulatory systems. The US FDA places considerable emphasis on long-term clinical evidence, quality management systems, and corporate compliance history under the Pre-market Approval (PMA) process. The EU MDR requires rigorous clinical evaluation, post-market clinical follow-up, and comprehensive benefit-risk assessment for Class III implantable devices. Although China’s NMPA provides a comparatively more accessible regulatory pathway, manufacturers remain subject to extensive review of prior regulatory actions and manufacturing compliance. Across all jurisdictions, historical regulatory non-compliance may substantially increase approval timelines, evidentiary requirements, regulatory scrutiny, and commercialization costs. Furthermore, restoration of physician confidence and market acceptance represents an additional challenge independent of regulatory approval. Conclusions: Successful market re-entry for high-risk implantable medical devices depends not only on regulatory approval but also on sustained corporate credibility, manufacturing transparency, and long-term stakeholder trust. The BellaGel case demonstrates that historical regulatory non-compliance may continue to influence international commercialization long after domestic regulatory issues have been addressed. Comparative evaluation of major regulatory systems provides valuable insights for manufacturers seeking global re-entry following significant regulatory violations.</p> </sec>
