Protection of Intellectual Rights in the System of Administration of Justice of the Service State: Seeking a Balance of Judicial Competence

<jats:p>The paper is devoted to the problem of the effectiveness of judicial protection of intellectual property in the context of the formation of a service state. The generally accepted criteria for delimiting judicial competence and the specifics of their application in the field of intellectual property law are examined. Using examples from judicial practice, the study addresses challenges related to the specialisation of courts and identifies gaps in ensuring the uniformity of judicial practice. Based on the findings, the author concludes that there is a need to revise approaches to the allocation of judicial competence in cases concerning the protection of intellectual property.</jats:p>
