Control (Supervisory) Activities in the Context of Digitalization

<jats:p>The article discusses the problem of distinguishing the concepts of control and supervisory activities of the state in the context of digitalization, which is relevant due to their frequent confusion in legislation and in practice. The novelty lies in the justification of the need to separate these concepts, taking into account modern challenges and functional features of state institutions. The purpose of the study is to identify the substantive and functional differences between control and supervision in the context of digitalization, as well as to consider its impact on their regulatory definition and application. The work uses a comprehensive method of analyzing legal and managerial sources, comparative legal and system-structural approaches, which made it possible to comprehensively consider the features of each category. The results of the study show that control covers a wider range of functions, including influencing the feasibility and effectiveness of the facility, while supervision is limited to checking legality and usually does not involve interference in economic activities. The conclusions indicate the need to establish a balance between the processes of convergence of the concepts under consideration, which have increased as a result of digitalization, on the one hand, and the separation of the regulatory definition of control and supervisory activities, on the other hand, in order to increase the effectiveness of its impact, as well as to reduce legal uncertainty.</jats:p>
