A Peasant (Farm) Enterprise as a Corporation: A New Stage in Legal Regulation

<jats:p>The article is devoted to the assessment of changes in the legislation on peasant (farm) economy. Attention is drawn to the fact that with the adoption of norms, in continuation of Art. 86.1 of the Civil Code of the Russian Federation on the regulation of peasant (farm) economy established as a legal entity, not all problems of important theoretical and practical significance were removed. In particular, the error in the wording of Article 86.1 of the Civil Code of the Russian Federation has not been resolved, which states that a farm is created on the basis of a previously established farm without the formation of a legal entity. The article analyzes the feasibility of classifying farms as corporate organizations due to the lack of necessary characteristics in farm corporations that are common to all corporate forms of legal entities. The article examines in detail the issue of subsidiary liability of the members of a farm corporation. Based on the analysis of these issues, it is concluded that the amendments to the Federal Law on Farm Corporations adopted in 2025 have only partially addressed the regulatory framework for farm corporations, and further clarifications are required to ensure the legal organization of their activities.</jats:p>
