Some Issues Arising in Connection with the Suspension of Criminal Proceedings in Court

<jats:p>This article is devoted to the issues related to the suspension of criminal proceedings in court. The author analyzes the grounds for suspending proceedings in court. It is substantiated that the confirmation of the accused’s whereabouts in another region or another country is possible by attaching requests to the relevant bodies, organizations, and institutions, as well as the corresponding responses received. The author is convinced that the suspension of proceedings is possible if there is a medical certificate (medical report) reflecting data on the defendant’s diagnosis, the duration of treatment, the severity of the disease, and the ability to participate in judicial and investigative actions. The article reveals when courts can apply the provisions of Clauses 3 and 4, Part 1, Article 238 of the Code of Criminal Procedure of the Russian Federation. It is argued that courts can suspend proceedings in connection with the performance of combat missions, and analyzes the data the court must have to make such a decision.</jats:p>
