An Indictment Order as a Criminal Procedure Instrument

<jats:p>This article is aimed at a comprehensive study of the decision to involve as an accused as an independent criminal procedure act, which occupies an important place in the mechanism of pre-trial criminal proceedings. The purpose of the study is to clarify the legal nature, to identify signs that distinguish this criminal procedure act from other procedural decisions of the investigator. The methodological basis of the study was formal-legal, systemic, comparative-legal and law enforcement methods. Conclusions. The article justifies the conclusion that the decision to involve as an accused has all the signs of criminal procedural acts. However, its significance is not limited to the formal granting of the status of an accused person. As a result of the study, the author comes to the conclusion that it is advisable to preserve the institute in question. Scientific relevance lies in rethinking the meaning of the decision to prosecute as an accused as an important criminal procedural act. Practical relevance lies in the formulation of areas for improvement of the resolution that can be used in practical activities</jats:p>
