Infrastructure Service: On the Question of Balancing Private and Public Interests in the Transport Sector

<jats:p>In the context of the balance of interests in the transport sector, an infrastructure service is examined as a legal means of regulating relations. It is noted that the formal enshrinement of the requirement to ensure a balance of interests within the regulatory framework does not guarantee its actual attainment. The paper substantiates an approach under which the infrastructure service is articulated through the category of access to infrastructure. The regulatory framework demonstrates a fragmented codification of the category of “access to infrastructure”, however, a consistent set of its inherent characteristics can be identified within the relevant legal provisions. It is concluded that an infrastructural service may be used as a legal means of organizing relations concerning the use of transport infrastructure and coordinating the interests of its participants.</jats:p>
