Evaluative Categories in Civil Procedure: The Paradox of Legal Certainty

<jats:p>This article addresses the problems of the extensive proliferation of evaluative categories in civil law proceedings and the risks of “contaminating” the legal body of law with evaluative constructs. It examines controversial issues of the absolute normativity of evaluative concepts, leading to the “paradox of legal certainty”, and the problems of “logical errors” in formulating and defining evaluative constructs. A model for using evaluative concepts is proposed, facilitating their uniform and effective application in civil law proceedings.</jats:p>
