The Role and Significance of Compensatory Proceedings in Improving the Efficiency of Arbitrazh Justice

<jats:p>This article presents the author’s perspective on compensatory proceedings as one of the key proceedings in arbitration proceedings aimed at ensuring the implementation of the principle of a reasonable timeframe. We view compensatory proceedings not as a mere measure of state responsibility, but as a public law guarantee for restoring the fundamental right to judicial protection. The author explores the legal nature of this type of judicial procedure. This is why, on the one hand, it serves as a preventive disciplinary tool, encouraging the optimization of internal judicial administration, and on the other hand, it is an optimal means of protection against non-pecuniary damage caused by the excessive duration of the arbitration procedure.</jats:p>
