Evolution of the Institution of Compensation for Infringement of Exclusive Rights: The Problem of Proportionality

<jats:p>Compensation for the infringement of exclusive rights is one of the most popular remedies, sparking debate about its legal nature and the proportionality of the amount to the nature of the infringement. Judicial practice plays a key role in understanding these issues, and its trends serve as a catalyst for legislative change. An important outcome was the adoption of Federal Law № 214 on July 7, 2025, introducing a new Article 1252.1 of the Civil Code of the Russian Federation. This article analyzes the issue of proportionality of compensation and the evolution of this institution under the influence of the legal positions of the Constitutional Court of the Russian Federation.</jats:p>
