LEGAL BARRIERS TO THE USE OF MUSEUM FUND OBJECTS BY SUBJECTS OF CREATIVE INDUSTRIES

<jats:p>The paper analyzes the legal barriers that arise when cultural heritage objects are used commercially by creative industries in the context of digital transformation. It is established that the dual nature of museum objects (as part of the Museum Fund of the Russian Federation and as the results of intellectual activity) requires double approval from the copyright holder and the museum management, which leads to increased costs and reduces the willingness of businesses to develop production. The paper argues that finding a balance between the public function of museums and the commercial interests of creative industries requires a differentiated approach to legal regulation. The criterion for exemption from obtaining permission to use museum items by creative industry entities is proposed to be the fact of obtaining an image from publicly available sources without actual access to the museum’s funds. This allows the museum to maintain control and the possibility of compensating costs in cases where.</jats:p>
