Индексация заработной платы как способ обеспечения повышения ее реального содержания: недостатки правового регулирования и противоречия судебной практики, Indexation of wages as a way to ensure an increase in their real content: shortcomings of legal regulation and contradictions in judicial practice

<jats:p>This article analyzes how one of the state-mandated labor guarantees-namely, ensuring a rise in the real level of wage content-is put into practice. The author explores, from a perspective of historical continuity, the specific legislative developments that shaped the content of this guarantee. Drawing on doctrinal views and enforcement practices, the study observes that Article 134 of the Labor Code of the Russian Federation, in its current wording, does not impose indexation as a binding obligation on the employer. An analysis of the formal approach to resolving individual labor disputes on this issue, which is often found in court decisions, allows the author to justify the expediency of legislative changes aimed at establishing minimum guarantees for wage indexation, including the mechanism for its implementation.</jats:p>
