Abstract

Suppose that an adult is morally responsible for having engaged in the sexual molestation of a child and that it is reasonable to believe that, unless he is restrained in some way, he will molest other children. He is, the author argues, morally liable to be restrained in a necessary and proportionate way as a means of defending other children from him. There are, however, two options: imprisoning him, and administering to him a treatment that will suppress his sexual desires for some period of time. This chapter suggests that the treatment may be the less harmful means and might thus be required by the necessity constraint if he consents to have it. It argues further that it may also be morally justifiable to administer it to him even if he withholds consent if the cost of imprisoning him would impose serious burdens on other individuals.
